TERMS & CONDITIONS
- All goods are stored at owner’s risk. Insurance is the responsibility of the owner.
- All persons entering the Tender Centre Wodonga, its offices, warehouse or place of viewing, do so at their own risk. All parents are responsible for their children's behaviour, action and safety. All breakages/damage must be paid for
- It is the Bidders responsibility to ensure the Bid form is legible and that intentions are clearly shown.
- Payment methods are to be by cash or Eftpos. Business or personal cheques will not be accepted.
- Bids will be accepted any day. The deadline for submitting a Bid is close of business each Sunday and is final.
- Bids may be hand delivered to the Tender Centre Wodonga at the place of viewing, emailed or faxed to arrive before the close of Bidding. Bids can also be submitted via our website.
- A Bid, once submitted, cannot be withdrawn and is irrevocable.
- If goods have been through one Sale, with no successful Bids, they become available for purchase from the floor at the reserve price plus the Buyer’s Premium.
- If a Bid is accepted within a period of seven days from the close of Bids, or if a price is subsequently negotiated it then become a legally binding contract to purchase as per these terms and conditions
- All Bids must be in whole dollars. All Bids submitted with "cents" will be rounded down to the nearest whole dollar.
- Tender Centre Wodonga, at its sole and absolute discretion, may decide to rule any Bid void.
- It is the Bidder’s responsibility to enquire as to whether or not their Bid has been successful.
- The highest Bid received above the reserve price (if there is a reserve price) shall be the successful Bid. the Tender Centre Wodonga shall not be required to disclose details of any Bid. No correspondence will be entered into in this regard.
- In the case of a tied Bid, negotiations will be entered into with the tied Bidders to achieve a successful Bidder.
- Bids submitted after close of sale may or may not be accepted at the discretion of the Tender Centre Wodonga.
- All goods, plant ,machinery ,vehicles, are sold "As is Where is". No warranties or guarantees are offered or implied and the Bidder relies solely on their own inspection and enquiries.
- It is the responsibility of the Bidder to ensure before submitting a Bid that the goods are suitable for the purpose for which they are intended. No allowance will be made for unsuitability after the Bid has been submitted.
- Descriptions of goods offered for sale are based on descriptions supplied by the Seller. Under no circumstances shall the Tender Centre Wodonga, its shareholders, employees or agents be liable for any misdescription, error or omission of a description be it in a catalogue, advertisement, brochure or any other medium.
- In the case of a dispute, any remedies, or actions taken by a Seller,
Buyer, Bidder or any other party shall lie against the Seller, Buyer, Bidder
or other party and under no circumstances shall any remidies or actions
lie against the Tender Centre Wodonga, its shareholders, employees
or agents.
- The title of goods and risk of goods is in the Sellers name until payment has been made by the Buyer, at which time the title of goods and risk of goods is are transferred to the Purchaser. At no time is the title or risk in the Tender Centre Wodonga's name.
- If goods are not paid for by the deadline displayed at the place of viewing, Tender Centre Wodonga, without giving notice to the Bidder may do all or any of the following:
- Charge a storage fee
- Declare the agreement void, contact another Bidder and inform them that their Bid has been successful and take legal action against the original Bidder for the difference.
- Take legal action against the Bidder to enforce this contract.
- The Bidder agrees to pay any Bid Premiums that may be displayed at the place of viewing.
- The Laws of Victoria shall apply to any Bid or Sale and these terms and conditions.
